Approved resellers will be required to sign a Reseller Agreement that outlines specific obligations, pricing structures, territories, and exclusivity arrangements.

2.3 Pricing and Discounts
Resellers will be provided with discounted pricing for bulk purchases. Resellers are responsible for adhering to any minimum advertised price (MAP) policies, where applicable. Non-compliance may result in termination of the reseller agreement.

2.4 Use of Brand and Marketing Materials
Resellers are permitted to use our marketing materials solely for promoting Non-stop Dogwear products. Any alteration or misuse of brand assets without prior approval is prohibited.

2.5 Territorial Restrictions
Resellers may only sell within the approved territories as specified in their Reseller Agreement. Sales outside of these areas without approval are strictly prohibited.

2.6 Product Returns and Exchanges for Resellers
Resellers must adhere to our standard returns policy unless otherwise specified in their Reseller Agreement.

2.7 Termination
We reserve the right to terminate a reseller relationship for failure to comply with these Terms of Service or the Reseller Agreement, or for conduct that harms the reputation of Non-stop Dogwear South Africa.

3. Ordering and Shipping

3.1 Order Acceptance
We reserve the right to refuse or cancel any order at our discretion. If payment has already been processed, a refund will be issued.

3.2 Shipping
Shipping costs and timelines will be provided at checkout. While we strive for timely delivery, we are not responsible for delays caused by third-party couriers or customs.

3.3 International Orders
International shipping may be subject to additional taxes, duties, and customs fees, which are the responsibility of the customer or reseller.

4. Returns, Exchanges, and Refunds

Our policies regarding returns, exchanges, and refunds are as follows:

4.1 Returns
Returns are processed at your own expense unless the item is defective or if there has been an error on our part. Please send returns via standard post or courier, as we do not accept cash-on-delivery returns or collect items from post offices.

In line with the South African Consumer Protection Act (CPA), you are entitled to return goods within 14 days of receipt without providing a reason. To initiate a return, please contact us within this period. Items must be returned unused, in original packaging, and with all tags and labels intact.

If the returned item shows excessive use or handling that diminishes its resale value, we may deduct an amount reflecting the depreciation of the item from the credit.

4.2 Damage in Transit
Upon receipt, please inspect your package for any transport-related damage. If you notice damage when collecting a package from a courier or pick-up point, please report it to the courier immediately, then contact us by email or phone.

4.3 Exchanges
We do not administer direct exchanges. If you wish to receive another item, please return the original item according to our return policy and place a new order for your desired item.

4.4 Refunds
Refunds are issued as credit to your Alphapacks Holdings account. We process credits as soon as possible, typically within 30 days of receiving the returned item. The item must be unused and returned with all original packaging and tags. Excessive handling may result in a deduction for depreciation.

4.5 Tracking and Proof of Return
You are responsible for ensuring that the returned item reaches us in full. Please retain a copy of your return receipt for proof of return and tracking purposes.

5. Prohibited Activities

By engaging with Non-stop Dogwear South Africa, you agree not to:

• Violate any laws or regulations.
• Misrepresent yourself or your business.
• Engage in activities that harm our brand or reputation.
• Re-sell products through unauthorized channels such as third-party marketplaces, unless explicitly permitted.

6. Dispute Resolution

6.1 Governing Law
These Terms of Service are governed by the laws of South Africa.

6.2 Dispute Resolution
Disputes arising from these terms will be resolved amicably where possible. If an amicable resolution cannot be reached, disputes will be subject to arbitration in  Cape Town, South Africa, as per South African arbitration laws.

Affiliate Terms of Use

As an authorized affiliate (“Affiliate”) of Alphapacks Holdings (Pty) Ltd, trading as Non-stop Dogwear South Africa, you agree to abide by the terms and conditions outlined in this Affiliate Terms of Use Agreement (“Agreement”). Please read the entire Agreement carefully before registering and promoting Non-stop Dogwear South Africa.

Your participation in the affiliate program (“Program”) is solely to legally advertise our website and products to earn a commission on memberships and products purchased by individuals referred to Non-stop Dogwear South Africa through your marketing efforts.

By registering for the Non-stop Dogwear South Africa Affiliate Program, you indicate your acceptance of this Agreement and its terms and conditions.

1. Approval or Rejection of Application

Non-stop Dogwear South Africa reserves the right to approve or reject any Affiliate Program application at its sole and absolute discretion. You will have no legal recourse against Non-stop Dogwear South Africa for the rejection of your application.

2. Commissions

• Commissions are paid monthly.
• To receive a commission, the referred account must remain active for at least 31 days.
• Self-referrals are prohibited, and commissions will not be paid for purchases made using your own account.
• Commissions are only paid for transactions that have been successfully completed. Chargebacks, refunds, or fraudulent transactions will not qualify for commission payments.

3. Termination

Your participation in the Program may be suspended or terminated at any time for the following reasons:

• Use of inappropriate advertisements, such as false claims or misleading hyperlinks.
• Spamming, including mass emails or newsgroup postings.
• Advertising on websites that promote illegal or inappropriate activities.
• Failure to disclose the affiliate relationship, as required under the South African Consumer Protection Act or similar regulations.
• Violating intellectual property rights, including unauthorized use of Non-stop Dogwear South Africa trademarks or branding.
• Offering rebates, coupons, or kickbacks from your affiliate commission as an incentive, unless pre-approved.
• Self-referrals or engagement in fraudulent transactions.

Non-stop Dogwear South Africa reserves the right to terminate any Affiliate account for violations of this Agreement or at its sole discretion, with or without cause.

4. Affiliate Links

• You may use graphic and text links provided by Non-stop Dogwear South Africa or create your own, provided they align with the terms of this Agreement.
• Affiliate links may be used on websites, email campaigns, and online or offline advertisements.

5. Coupon and Deal Sites

Affiliates promoting Non-stop Dogwear South Africa through deals or coupons must adhere to the following:

• Only authorized affiliates with pre-approved coupons may promote such deals.
• Misleading language or imagery implying unauthorized deals or coupons is strictly prohibited.
• Affiliates must not create pop-ups, pop-unders, iframes, or other actions that automatically set affiliate cookies without user consent.
• Landing pages with “Click for Deal/Coupon” messaging are not allowed if no deals or coupons exist.

6. Pay-Per-Click (PPC) Policy

PPC bidding is not allowed without prior written approval from Non-stop Dogwear South Africa.

7. Use of Logos and Graphics

• Affiliates are granted permission to use logos and branding materials only after approval of their application.
• All branding materials must remain unaltered and comply with Non-stop Dogwear South Africa’s style guide, if provided.
• Misuse or unauthorized use of logos or branding will result in immediate termination from the Program and may lead to legal action.
• Upon termination of your Affiliate account, you must remove all branding materials from your websites and promotional materials within seven (7) days.

8. Liability

Non-stop Dogwear South Africa is not liable for indirect or accidental damages (including loss of revenue or commissions) due to tracking failures, database errors, or other interruptions of the Program.

We make no warranties, expressed or implied, regarding the Program’s functionality or the products and services offered by Non-stop Dogwear South Africa.

9. Term of Agreement

The term of this Agreement begins upon your acceptance into the Program and continues until your Affiliate account is terminated.

Non-stop Dogwear South Africa reserves the right to modify this Agreement at any time. Continued participation in the Program after changes are made constitutes your acceptance of the revised terms.

10. Indemnification

As an Affiliate, you agree to indemnify and hold harmless Non-stop Dogwear South Africa, its affiliates, employees, and partners, from any claims, damages, or expenses arising from your participation in the Program or violations of this Agreement.

11. Electronic Signature

This Agreement is an electronic contract that sets out the legally binding terms of your participation in the Non-stop Dogwear South Africa Affiliate Program. By completing the affiliate application, you provide an electronic signature with the same legal force as a handwritten signature.

Use of Logos and Graphics

5.1 Approval for Use
The use of Non-stop Dogwear South Africa logos, graphics, and other brand assets is strictly limited to approved resellers and affiliates. Authorization is granted only upon approval of the reseller or affiliate application. Unauthorized use of any branding materials is prohibited and may result in legal action.

5.2 Permitted Use
Approved resellers and affiliates may use our logos, images, and marketing materials solely for the promotion and sale of official Non-stop Dogwear products. Use must comply with the following guidelines:

• Branding materials may not be altered, distorted, or modified in any way.
• Logos must be displayed in their original colors and proportions.
• Graphics must be used in accordance with the style guide provided by Non-stop Dogwear South Africa (if applicable).
• Marketing materials must not be used in any manner that may mislead, deceive, or harm the reputation of the brand.

5.3 Prohibited Activities
Resellers and affiliates may not:

• Use logos or graphics in any way that implies endorsement, partnership, or sponsorship outside the scope of the approved reseller/affiliate relationship.
• Use branding materials in association with obscene, defamatory, illegal, or harmful content.
• Repurpose logos and graphics for the promotion of non-Non-stop Dogwear products or unrelated services.

5.4 Termination of Use
The right to use Non-stop Dogwear South Africa logos and graphics automatically ends upon the termination or suspension of the reseller or affiliate agreement. Upon termination:

• All marketing materials containing logos and graphics must be removed from websites, social media accounts, and any other platforms within seven (7) days.
• Any remaining inventory with branding elements must not be sold without prior written approval.

5.5 Brand Protection
To safeguard our brand identity, Non-stop Dogwear South Africa reserves the right to monitor the use of all logos, graphics, and branding materials. Misuse or unauthorized representation may lead to immediate revocation of reseller/affiliate status and legal action where necessary.
